Refunds & Exchanges

Customer shall inspect product received from Nelson and Nelson Enterprises, LLC dba PowerWiper  (“N&N”), and notify N&N of any damage or discrepancy in product shipped, number or type within 10 days of receipt of product. Customer and N&N shall work together in good faith to remedy damage or discrepancy. Failure to notify N&N of any damage or discrepancy within 10 days of receipt of product shall constitute Buyer’s acceptance of product and shall constitute Customer’s waiver of such claims. There is a $5.50 dollar re-stocking fee.

Warranty and Disclaimer

The products provided by Nelson and Nelson Enterprises, LLC dba PowerWiper (“N&N”), are intended to be used as windshield wipers on motorized land vehicles in conjunction with the vehicle manufacturer’s windshield wiper system. This limited warranty covers defects in material or workmanship under normal use for a period of 90 days from the date of shipment (“Warranty Period.”) During the Warranty Period, N&N will repair or replace, at no charge, the part of the product, excluding rubber, that proves defective due to improper material or workmanship under normal use and maintenance. Pulling wipers away from a windshield, either manually or by turning on the wiper system after the wiper is frozen to the vehicle and prior to allowing the area to thaw, thereby causing the rubber wiper blade to tear, is specifically excluded from normal use.

The limited warranty does not cover any problem whatsoever beyond the repair or replacement of the defective product. The limited warranty does not include consequential damages, whether foreseeable or otherwise, lost time, lost profits or any other damages whatsoever beyond the repair or replacement of the defective part. The warranty, further, does not include loss due to negligence, loss of the product, theft or accident, natural disasters, hailstorm or other unusually severe weather, damage resulting from modification of the product after delivery by N&N.

A replacement part assumes the remaining Warranty Period of the original part or 90 days from the date of replacement (shipment by N&N), whichever is longer.

THE LIMITED WARRANTY SET OUT ABOVE IS THE ONLY WARRANTY PROVIDED BY NELSON AND NELSON ENTERPRISES, LLC AND THE REMEDIES SET OUT ABOVE ARE THE SOLE AND EXCLUSIVE REMEDIES OF CUSTOMER FOR ANY CLAIMED BREACH OF WARRANTY. EXCEPT AS EXPRESSLY SET OUT ABOVE, THERE ARE NO OTHER WARRANTIES OR CONDITIONS EXPRESSED OR IMPLIED AND NELSON AND NELSON ENTERPRISES, LLC HEREBY EXPRESSLY DISCLAIMS ALL OHER WARRANTIES, CONDITIONS AND REPRESENTATIONS, EXPRESS OR IMPLIED, WHETHER BY STATUTE, COMMON LAW, CUSTOM, USAGE OR OTHERWISE, INCLUDING WARRANTIES AND CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Some states/countries do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights and you may have other rights that vary by state or country.
